# Terms of Service

## General Terms of Service

YecoAI reserves the right to modify these terms. Specific products (including EnderDevelopment and DeskNexo) may have additional terms that take precedence for that offering.

These General Terms of Service ("Terms") govern the contractual relationship between YecoAI di Marco Nasi ("the Seller"), Sole proprietorship, VAT 04219920040, Via Vecchia di Frabosa 10, 12084 Mondovì (CN), Italy, and anyone who purchases services on www.yecoai.com ("the Customer").

## Pre-contract information

Before purchase you are informed of: the main characteristics of the service; the Seller identity and contacts (including PEC); the total price in EUR including applicable VAT; the duration of the contract or subscription; the right of withdrawal where applicable; and how to lodge a complaint (support@yecoai.com).

## Payments and Refunds

All prices are in Euros (EUR) and include applicable VAT unless stated otherwise. Payment must be made in full at purchase unless otherwise agreed in writing. For product-specific refunds, see the product page or contact support@yecoai.com.

## Right of Withdrawal (Consumers Only)

Under Arts. 49–58 of the Italian Consumer Code (D.Lgs. 206/2005) and Directive 2011/83/EU, consumers may withdraw from a distance contract within 14 calendar days of conclusion, without reason or penalty. To withdraw: inform YecoAI at support@yecoai.com or PEC marco.nasi@pec.yecoai.com with a clear statement (order number, date of order, date of withdrawal, name, email). You may use the model withdrawal form in Annex I, Part B of Directive 2011/83/EU. Reimbursement of all payments within 14 days, same payment means unless agreed otherwise.

Digital content exception: per Art. 59(h) Consumer Code, withdrawal does not apply to digital content not on a tangible medium if performance began with the consumer's prior express consent and acknowledgment that withdrawal is lost once delivery begins. That consent and acknowledgment are collected at checkout where applicable. B2B: the right of withdrawal does not apply to business/professional customers.

## Service Delivery and Obligations

Services are provided per written specifications and timelines. Schedules may change for technical difficulties, force majeure, or third-party disruptions beyond reasonable control. Customer must provide accurate information and is solely responsible for account credentials and activity under their account.

## Limitation of Liability

To the fullest extent permitted by law, YecoAI is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, use, goodwill, or other intangibles arising from use or inability to use services. Total aggregate liability shall not exceed amounts paid to YecoAI for the specific service in the 12 months before the claim. Consumer notice: these limits do not apply to consumers under D.Lgs. 206/2005 and do not exclude liability for willful misconduct or gross negligence.

## Intellectual Property and Third Parties

All IP in the services remains exclusive property of YecoAI or licensors. Customer receives a limited, non-exclusive, non-transferable license for internal business purposes only, unless a product license states otherwise. Services may involve partners including EnderDevelopment, under separate terms.

## Termination and Governing Law

Either party may terminate for material breach if not cured within a reasonable period after written notice. YecoAI may suspend service for security, unpaid invoices, or legal compliance. For consumers, mandatory protective rules of the Consumer Code remain unaffected. Italian law; exclusive jurisdiction: courts of Cuneo, without prejudice to Art. 33 Consumer Code for consumers. ## Website Terms of Use

By accessing or using the YecoAI website you agree to these Terms. Lawful purposes only: no violation of laws, no interference with Site operation or security, no unauthorized access, no scraping, no malicious code. All Site content is property of YecoAI, protected by IP law; no reproduction or derivative works without express written permission.

Disclaimer: the Site is provided "as is" without warranties. Limitation of liability for mere website browsing: total liability shall not exceed €100 (consumer notice: limits do not apply to consumers under D.Lgs. 206/2005). Third-party links are not controlled by YecoAI. Terms may change with ≥15 days notice via Site; urgent legal/security changes may take effect immediately.
